9th Circuit Appears to Seek SCOTUS Review – Does the 2nd Amendment Apply to States?
9th Circuit opens door for review of Nordyke v. King in which the three-judge panel affirmed that the 2nd Amendment does apply to States through the Due Process Clause and the 14th Amendment. This en banc review now takes that precedent away from lower courts and positions case for potential review from SCOTUS.
